There will be no Judicial Review into the legalities behind the Marshoot Lane housing development, according to Council Officials.
In January, it was revealed that Hailsham Town Council was appointing a lawyer at a cost of £5000, to decide if the decision to build more than 200 homes on land at Marshfoot Lane was lawful.
A spokesperson has today told Hailsham News; “The Council has received the professional legal opinion that ‘there is no viable ground on which Hailsham Town Council could make an application for judicial review’.
“The Council therefore resolved to follow this advice and not pursue the matter further.”
Wealden Planning officers gave a hesitant green light to build 238 homes on land off Marshfoot Lane, despite fears of increased traffic levels and pollution, along with a lack of appropriate wildlife reports and surveys.
